Criminal law – Prosecution. The appellant River Manager appealed by way of case stated against the judge's decision that she had not had power to lay summonses against the respondents, and that the Conservators of the River Cam had not shown that they had exercised oversight and review of their prosecutorial function. The Divisional Court, in allowing the appeal, held that the judge had been correct in finding that the Conservators had not been entitled to delegate completely the function of bringing prosecutions. However, he had not been entitled to find that the Conservators had not shown that they had exercised oversight and review of their officer's prosecutorial function.
