Responding to the recent widening of the range of cases prosecuted bythe CPS, the new Code presents overarching principles that can be applied to every case. It also adds extra clarification on whether there is sufficient evidence to prosecute and the effect of a prosecution on the victim’s health, and sits alongside existing legal guidance on specific offences. The Code retains reference to proportionality as a consideration under the public interest stage of the test, which was part of the consultation and featured previously in the 1986 and 1992 versions of the Code.
