De Capitani v European Parliament

European Union – Information. The applicant had applied, pursuant to art 263 of the Treaty on the Functioning of the European Union for annulment of Decision A(2015) 4931 of the European Parliament, refusing to grant the applicant full access to certain documents which contained provisional compromise texts and preliminary positions of the Presidency of the Council concerning an ongoing legislative procedure. In granting that application, the General Court of the European Union held that none of the grounds relied on by the European Parliament demonstrated that full access to the documents at issue was likely to undermine, specifically and actually, the decision-making process at issue within the meaning of the first subparagraph of Regulation (EC) No 1049/2001.
