Police – Chief constable. The Queen's Bench Division allowed the appellant's appeal against the judge's decision striking out his claim for damages for negligent misstatement against the respondents by the second respondent's statement to a selection panel concerning his application for the post of a Chief Constable of Police. There had not been a sufficient evidential basis for the judge's assumption that the second respondent's advice had been given in the exercise of a statutory function and a duty was sought to be imposed only on matters falling outside her remit to give advice.
