Sargeant v Sargeant and another

Practice – Commencement of proceedings. The claimant's application for permission to bring proceedings seeking an order for provision from the estate of her husband was dismissed. The Chancery Division held that the delay in bringing the proceedings had been the result of the claimant taking her own decision to continue to work within the arrangements provided for by a will rather than to explore whether she had any option available to vary them, in the full knowledge of the financial difficulties she had been under.
