Accordingly, the Divisional Court dismissed the appellant's appeal, relying on arts 3 and 6 of the European Convention on Human Rights, against the judge's order, sending the Secretary of State a request for his extradition to Russia to serve a sentence of 18 months' imprisonment for fraud.
