In a claim arising from the defendant insurance broker's alleged negligence, the lack of expert evidence significantly limited, though it had not altogether excluded, the possibility of a finding that the defendant's conduct was such as to constitute a breach of the common-law duty of care or the contractual obligation to exercise reasonable skill and care. The Queen's Bench Division held, on the evidence, that the defendant was not in breach of duty and dismissed the claimant company's claim.
