Wealden District Council v Secretary of State for Communities and Local Government and others

Town and country planning – Planning authority. The Planning Court quashed policies of the third defendant local planning authority's development plan based on advice given by Natural England, to the effect that the levels of traffic generated by the joint core strategy were not significant, which had been erroneous. The case fell within the exceptional category of case where, at the very least, further specific inquiry of Natural England had been necessary.
