Thakkar v Thakkar

Divorce – Decree absolute. The Family Division dismissed the husband's application for a decree absolute in circumstances where the wife had chosen not to apply for it pending resolution of her financial remedies application and there was a dispute between the parties about the extent of the husband's assets, some of which were held offshore. In the circumstances, the potentially complex structures in which the assets were held, and the impact which being a wife or ex-wife might have had on the wife's remedies, constituted special circumstances which over-rode the presumption in favour of ending the marriage.
