Judicial review – Cross-examination. The claimant's application to cross-examine a palliative care consultant promoted the constitutional issue of whether it was appropriate for the court to hear primary evidence on issues of policy, in the context of a challenge to the proportionality of s 2 of the Suicide Act 1961, or whether that was something that only Parliament should appropriately do. Accordingly, the Divisional Court adjourned the application to be determined following the determination of that preliminary issue.
