Family proceedings – Orders in family proceedings. The Family Division dismissed an application by the father, F, for the summary return of his daughter, L, to Turkey following her removal to England by the mother, M. In view of M's allegations that F had subjected her to abuse, which were objectively verifiable by the evidence put before the court, it was accepted that ordering L's return to Turkey presented a grave risk that L would be exposed to the risk of physical or psychological harm, or otherwise be placed in an intolerable situation, for the purposes of art 13(b) of the Hague Convention on the Civil Aspects of International Child Abduction 1980.
