Roocroft v Ball (Personal Representative of the Estate of Ainscow (Deceased))

Family proceedings – Orders in family proceedings. The Court of Appeal, Civil Division, found that the trial judge had erred in law in deciding on a summary basis not to set aside a consent order made following the dissolution of a civil partnership for material non-disclosure. The matter would be remitted to the High Court for a rehearing to determine whether, on the evidence, there had in fact been material non-disclosure, despite the appellant agreeing to the making of the order.
