Roezner v Prosecutor General's Office of the Republic of Poland

Extradition – Oppression. The fresh evidence did not establish to the high threshold necessary that there was a risk that the appellant would commit suicide and new material did not in any way undermine the relevance of the factors the judge had considered with respect to the balance under art 8 of the European Convention on Human Rights. Accordingly, the Administrative Court dismissed the appellant's appeal against orders for his extradition to Poland to serve the remaining one year, five months and nine days of a sentence of two years' imprisonment for joint‑enterprise armed robbery.
