Re Herbert (application under para 3 of Sch 22 to the Criminal Justice Act 2003)

Sentence – Mandatory life sentence. The Administrative Court refused to recommend that the offender's tariff for murder and grievous bodily harm with intent be reduced from 15 years and 6 months, from which was to be subtracted the days served on remand. There was insufficient to demonstrate that the offender's progress met what was a relatively high standard of exceptional and unforeseen progress.
