Prison – Negligence. The defendant Ministry of Justice was not liable, directly, vicariously or due to its non-delegable duty of care, for the admittedly deficient medical care the claimant had received while in prison, resulting in the amputation of his leg above the knee. The Queen's Bench Division, in dismissing the claimant's clinical negligence action, further held that his claim under the Human Rights Act 1998 was time-barred.
