Sentence – Custodial sentence. The Court of Appeal, Criminal Division, held that, in assessing 'dangerousness', pursuant to s 229 of the Criminal Justice Act 2003, the court ought to apply the test of 'significant risk' to defendants under the age of 18, not a more stringent statutory test of 'a very grave risk'. In the present appeal against sentence, the judge had not erred in making a finding of dangerousness against the defendant nor by having passed a sentence of detention for public protection, rather than an extended sentence.
