Employment – Working time. The defendant Fire and Rescue Authority's shift system which involved periods during a working week of 96 hours of continuous duty, other than during brief respite periods that follow if a firefighter was called out at night, was contrary to the rights of firefighters under reg 10 of the Working Time Regulations 1998, SI 1998/1833. The Administrative Court also found reg 6 breached, but held it would not be right to declare the Authority in breach of reg 6 without criminal procedural safeguards being available to it.
