Immigration – Removal. The judge had proceeded on the basis of a fundamental mistake of fact in having granted an order requiring the defendant Secretary of State to prevent the claimant Afghani national from boarding a fight and requiring her to return him and there were no other grounds to justify the order. The Court of Appeal, Civil Division, in allowing the Secretary of State's appeal, further held that that order had infected a second order and a third order was predicated on the previous orders having been valid.
