Immigration – Detention. The Administrative Court found that two claimants had been unlawfully detained, as the Secretary of State had failed to properly follow her own policy on the detention of a person about whom there was independent evidence that he had been tortured. However, it dismissed the claims of unlawful detention relying on art 28 of European Parliament and Council Regulation (EU) 604/2013 and the principles in R v Governor of Durham Prison, ex p Singh ([1984] 1 All ER 983).
