R (on the application of Jollah) v Secretary of State for the Home Department (No 2)

Immigration – Detention. The appropriate amount of compensatory damages that the law required to be paid to the claimant for his curfew unlawfully imposed by the defendant Secretary of State was a sum of £4,000. The Administrative Court set out the appropriate test for determining whether only nominal damages should be awarded and refused to award aggravated damages, as the amount of damages fully compensated the claimant for the effect upon him of the unlawful imposition of the curfew.
