R (on the application of Boot) v Elmbridge Borough Council

Town and country planning – Permission for development. The Planning Court quashed the defendant local planning authority's decision to grant planning permission for a football and athletics ground on Green Belt land. The adverse impact on the openness of the Green Belt land, however limited, had not been acceptable for the purposes of para 89 of the National Planning Policy Framework and permission had been granted without consideration of whether there had been very special circumstances that would justify it.
