Sentence – Fine. The Court of Appeal, Criminal Division, allowed the defendant company's appeal against sentence of a fine of £160,000 for one count of failing to take suitable and sufficient measures to prevent any person falling a distance liable to cause personal injury, contrary to s 33(1)(c) of the Health and Safety at Work etc Act 1974. In all the circumstances, the imposed fine of £160,000 would be quashed and substituted for a fine of £80,000. That fine met the objects of the legislation to mark and signify the breach that took place in the present case.
