The Chancery Division dismissed the claimant's application for, among other things, a stay in proceedings that he had commenced against the defendants, who had previously been his lawyers. The claimant contended that, as he was detained in Russia, it was difficult for him to instruct his representatives. The court held that the claimant had not discharged the onus of showing a real and not merely notional risk of injustice.
