Court of Session: Refusing a judicial review petition by a failed Iranian asylum seeker of Kurdish ethnicity, challenging a decision refusing to treat his further submissions as a fresh claim, the court rejected contentions that the respondent had failed to apply the correct test, or had not applied the correct test in the correct manner, and held that she was entitled to conclude that material concerning the petitioner's activities in the UK and two photocopy documents did not create a realistic prospect of success in a second asylum appeal.
