The claimant had not fully recovered from a previous car accident and his injuries had been exacerbated by the index accident. The prognosis of the pain and stiffness to the neck and shoulder was to fully resolve between 10 and 12 months. The medical report said the index accident attributed to 40% of the claimant's injuries. The method of calculation of damages was accepted as calculating the value of a 10–12-month injury (averaged at 11 months) and 40% of its duration. The overall period would probably have been worth £3,200, so the claimant's claim was worth 40% of that, ie £1,280.
