Sentencing – Proceeds of crime – Confiscation order: Court of Session: Refusing an appeal against the making of a confiscation order under the Proceeds of Crime Act 2002 by an appellant who pled guilty to being concerned in the supply of cocaine and was admonished, the court held that the sheriff's decision that there was no risk of serious injustice in making four statutory assumptions relating to the appellant, his assets and his lifestyle was one he was entitled to make on the evidence before him, he was correct to find that it was proportionate to make the confiscation order, and he had not adopted an incorrect blanket approach to the various items of property in the appellant's possession.
