Family proceedings – Jurisdiction. The judge had power under the residual domestic jurisdiction in s 8 of the Children Act 1989 to allow the appellant father's application for a child arrangements order and prohibited steps order, even if the children were not habitually resident in the UK. Despite failing to exercise this power, the judge's decision to discharge the prohibited steps order and allow the respondent mother and children to return to Canada was correct.
