Land registration – Overriding interest. The Chancery Division held that the grant of a right of way in favour of the claimants, after land had been sold to the defendant, had been effective. Although the defendant had been in 'actual occupation' of a yard on his land, his rights had been overreached and subordinated to the right of way granted in favour of the claimants' barn.
