Disclosure and inspection of documents – Production of documents. The Technology and Construction Court allowed the claimant company's application for the disclosure of certain documents in the course of a dispute concerning a tendering process. The court held that it would be inappropriate to decide whether or not there was a serious issue to be tried without a sight of at least some of the documents being sought, particularly those going to the heart of the defendants' consideration of the successful tender. There was no principle that, in the usual case, an application for specific disclosure would not be heard in advance of an application to lift the suspension of a party's ability to enter into a proposed contract.
