Immigration – Asylum – Age assessment. Court of Session: In an action of declarator in which an Afghan asylum seeker challenged a local authority's assessment of his age and the local authority contended that the action was incompetent as the correct procedure was judicial review, the court was satisfied that declarator was a competent remedy, however it held that judicial review was also available and that all future challenges should be by way of judicial review as there were decisive advantages to proceeding by that route.
