Immigration – Circumvention of immigration control. The Court of Appeal, Civil Division, dismissed the appellant transport company's appeal against the judge's decision reducing the penalty imposed by the respondent Secretary of State for the entry of clandestine entrants into the United Kingdom. It had been open to the judge to have concluded that the defence of having an effective system for preventing the carriage of clandestine entrants which was being properly operated had not been made out and he had made an entirely appropriate reduction of the penalty.
