Court of Session: Dismissing an action in which a company in liquidation sought to recover from its sole director and shareholder payments to him which were averred to have been gratuitous alienations, and he averred that he was neither resident nor domiciled in Scotland and that the court did not have jurisdiction, the court held that the defender was not resident in Scotland when the action was raised and the pursuer had failed to prove that he was domiciled in Scotland.
