Seetohul v Omni Projects Ltd

Employment – Dismissal. The claimant was absent from his work for a fortnight. On his return, the defendant employer gave him a letter expressing concerns and, shortly afterwards, terminated his employment. The Mauritian Industrial Court allowed the claimant's claim for unfair dismissal, but it was substantially overturned by the Supreme Court on appeal. The Privy Council held that the Supreme Court had not erred in its approach to the applicable law, and dismissed the claimant's appeal.
