Mental health – Prisoner. Six cases were heard together, in which each defendant had been given an indeterminate sentence, either imprisonment for public protection or a life sentence, and had subsequently been transferred to hospital under s 47 of the Mental Health Act 1983. The Court of Appeal, Criminal Division, considered in each case whether fresh evidence established that the sentence passed by the judge should have been a hospital and restriction order under s 37/41 of the Act or whether the indeterminate sentence had been correct.
