The Administrative Court dismissed the claimant Nationwide Association of Fostering Providers' judicial review proceedings, contending that the defendant local authorities had failed to comply with the duty set out in s 22C(5) of the Children Act 1989. On the proper interpretation of s 22C(5) of the Act, the challenge to the lawfulness of the authorities' polices was misconceived.
