Practice – Settlement of action. The claimant had commenced libel proceedings against the defendants. The parties subsequently entered into a confidential settlement agreement. The claimant sought an injunction against the defendants, with a view to enforcement, and also an inquiry as to damages occasioned by the alleged breaches of the agreement. The Queen's Bench Division, in dismissing the applications, held that the difficulties of interpretation that would repeatedly arise would render the clause at issue too vague and uncertain, as to the scope of the obligation imposed, for it be enforceable.
