The Court of Appeal, Civil Division, allowed an appeal against dismissal of a challenge against confirmation of a compulsory purchase order (CPO) regarding the site of Shepherd's Bush Market. The market traders had been substantially prejudiced by the Secretary of State's failure to comply with a relevant requirement, namely the duty to give reasons, in disagreeing with the inspector's recommendation that the CPO should not be confirmed.
