The Court of Justice of the European Union made a preliminary ruling concerning the interpretation of art 93(5) of Council Regulation (EC) 40/94 (on the Community trade mark), and of art 5(3) of Council Regulation (EC) 44/2001 (on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters). The request has been made in proceedings between Coty Germany GmbH and First Note Perfumes NV concerning an alleged infringement of a Community trade mark and of the German Law against unfair competition, on account of the sale in Belgium of counterfeit products to a German trader which had resold them in Germany.
