Damages – Personal injury. The claimant was arrested by two police officers. In the course of the arrest the claimant was badly injured and he brought a claim for damages against the defendant Commissioner of the Police. The Queen's Bench Division held that although the claimant had not been deliberately assaulted by the police, they had used unnecessary and unreasonable force to restrain him, which in effect amounted to an assault. Accordingly, the claimant was entitled to damages.
