Education – Teacher. The Administrative Court allowed the appellant's appeal against the respondent Secretary of State's order prohibiting him from teaching indefinitely following a conviction for sexual assault. Section 141A of the Education Act 2002 did not allow for the referral to the Secretary of State of a person who was not employed as a teacher either at the time of the conduct or at the time of the referral and the appellant had only been a teacher for one term 12 years prior to the misconduct.
