Employment – Transfer of undertakings. The employee was dismissed for redundancy after stating that he wished to relocate to the Phillipines (as part of a TUPE transfer) on United Kingdom terms and conditions. The Employment Appeal Tribunal allowed the employer's appeal against the employment tribunal's decision that there had been a variation of the employee's contract of employment by which he was entitled to work in the Phillipines on UK terms and conditions, and that he was not redundant.
