The First-tier Tribunal (Immigration and Asylum Chamber), in upholding the respondent Secretary of State's refusal of a residence card, had been entitled to conclude that the appellant Pakistani national had failed to discharge the burden of proving that his marriage to a Lithuanian national had been genuine. Accordingly, the Court of Appeal, Civil Division, dismissed his appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber), upholding that decision.
