Sale of goods – Passing of property. The Court of Appeal Civil Division upheld a decision of the trial judge who had found that the claimant holiday makers could recover damages from the defendant travel company pursuant to the implied condition in s 4(2)of the Supply of Goods and Services Act 1982 for acute gastroenteritis suffered whilst staying at a hotel on an all-inclusive holiday. The food and drink supplied to the claimants at the hotel were goods in which propert could be transferred.
