Will – Attestation. The Chancery Division, in the claimant's proceedings initially under the Inheritance (Provision of Family and Dependants) Act 1975, determined that his father's will was valid. Although the presumption of due execution could not be relied upon, as the evidence was in conflict with the terms of the attestation clause, the accepted evidence from both the attesting witnesses established due execution.
