On the balance of probabilities, the claimant's gastric bypass would have been a success but for the defendant NHS Trust's surgical negligence and delay in diagnosing the anastomotic leak that followed surgery. Accordingly, the Queen's Bench Division, held that the NHS Trust should pay damages to the claimant, including a sum of £100,000 for pain, suffering and loss of amenity.
