Animal – Dog. The appellant succeeded in his appeal against the decision of the Crown Court, making a contingent destruction order in respect of his pit bull terrier type dog, absent a finding of fact as to whether the dog's walker had been a person 'for the time being in charge of' the dog. Accordingly, the Divisional Court remitted the case for the determination of whether, in the circumstances the dog's walker had been the person for the time being in charge of the dog under s 4B(2A)(ii) of the Dangerous Dogs Act 1991.
