Road traffic – Offence. The Divisional Court held that the Vehicle Drivers (Certificates of Professional Competence) Regulations 2007, SI 2007/605, and in particular reg 9(2), that an existing licence holder for a relevant vehicle category had to obtain a certificates of professional competence and within five yearly periods thereafter was not ultra vires and unenforceable against the appellant. Accordingly, his conviction for driving a minibus without having completed the periodic training had to stand and his appeal was dismissed.
