Warwick v Procurator Fiscal, Dumfries

Statutory offence – Resisting police officers in execution of their duty. Sheriff Appeal Court: Refusing an appeal against a sheriff's decision to repel the appellant's minute objecting to the lawfulness of the actings of police officers who would speak to the charges on a complaint against him containing three charges, who took hold of him at the locus in the first charge, the court held that the appeal was incompetent and, in any event, the sheriff was entitled to conclude that, in taking hold of appellant, the police were acting in the course of their duties.
