Trade mark – Infringement. The defendant company, easyGroup Ltd, which had been formed by the founder of the budget airline 'easyJet', had considered that the claimant company (W3) had infringed easyGroup Ltd's EU trade marks by use of the sign 'EasyRoommate' in relation to an online service for sharing accommodation in the UK and eight other EU member states. The Chancery Division held, among other things, that W3 was entitled to a declaration that easyGroup Ltd's 'EASY' trade mark had, at all times, been invalidly registered in relation to 'advertising' and 'temporary accommodation'. The court further held that W3 had not infringed any of easyGroup Ltd's EU trade marks by use of an of the signs complained of in the UK, and that it was not liable for passing off.
