The Court of Justice of the European Union gave a preliminary ruling deciding that art 7(2) of Regulation (EU) No 492/2011 should be interpreted as precluding legislation of a member state, such as that at issue in the main proceedings, which, with the aim of encouraging an increase in the proportion of residents with a higher education degree, made the grant of financial aid for higher education studies to a non-resident student conditional on at least one of that student's parents having worked in that member state for a minimum and continuous period of five years at the time the application for financial aid was made, but which did not lay down such a condition in respect of a student residing in the territory of that member state.
